Silicon Valley Bank Crisis Continues to Unfold, Updates Rolled out from the Federal Reserve, Treasury and FDIC

Monday, March 13, 2023 – The near-term crisis has largely been averted with the Federal Reserve, Treasury and FDIC regulators announcing that depositors regained access to 100% of their money starting Monday and that no losses will be borne by the taxpayer. The move should restore confidence and keep startups solvent and their employees employed, but there likely will be some longer-lasting psychological effects relating to capital risk that we should all be on the lookout for.

As the situation is analyzed, lessons will be learned on everything from levered banking investment models and the impact of interest rate fluctuations on long term bonds to the allocation to cyrptocurrency investments. We’ll continue to support our members and their portfolio companies by discussing and breaking down that information via our articles, webinars and at Summit 2023.

While a run on a bank by current depositors can clearly accelerate negative trends, we must also be mindful of the responsible support of the startup ecosystem that can and should come from venture capitalists, angels and other stakeholders. As they have proved time and time again, angels have embraced portfolio companies even in times of tougher fundraising and worked vigorously to keep startups, and job growth, moving forward. Look for future analysis of these points as more information becomes available.

At ACA, we commend the VC’s and angels that have rallied around their entrepreneurs to repurpose lessons learned from the 2008/2009 recession. One positive response can be seen in the more than 300 venture capital firms that have signed a letter saying they would be willing to work with Silicon Valley Bank under new ownership provided it is appropriately capitalized.

From the U.S. House Committee on Financial Services: “Silicon Valley Bank (SVB) was closed by the California Department of Financial Protection and Innovation (DFPI), and the Federal Deposit Insurance Corporation (FDIC) was named as receiver. The FDIC also created the Deposit Insurance National Bank of Santa Clara (DINB) as a short-term vehicle to facilitate SVB’s resolution…SVB was the 16th largest bank in the U.S., and its failure is the second largest U.S. history, behind only the 2008 failure of Washington Mutual with roughly $300 billion in total assets. As of December 31, 2022, SVB had about $209 billion in total assets and about $175 billion in total deposits. Roughly $151 billion of those deposits were uninsured.”

Additionally we believe, now more than ever, it is critical that the financial thresholds for the accredited investor definition remain unchanged as ALL of our communities need access to capital, particularly those historically lacking such access. ACA will continue to follow and support the angel community and communicate as appropriate as changes occur.

The Hans Severiens Award: recognizing an individual’s or team of individuals’ work in advancing the field of angel investing, named after the founder of the Band of Angels. The Hans Severiens Award is presented annually to recognize an individual or team of individuals’ work in advancing the field of angel investing.

The Luis Villalobos Award: recognizes the most ingenious and innovative ideas recently financed by members of the Angel Capital Association. Two category winners will be selected to attend the ACA Summit and honored live and throughout the event. Premium Processing Now Available for F-1 Students Seeking OPT

Dear Stakeholder,

For the first time ever, international F-1 students can request premium processing for their Form I-765, Application for Employment Authorization filed under one of these categories:

(c)(3)(A): Pre-completion optional practical training (OPT)
(c)(3)(B): Post-completion OPT
(c)(3)(C): 24-month extension of OPT for science, technology, engineering, and mathematics (STEM) students

If you fall into an eligible category above and:

Your Form I-765 is already pending with U.S. Citizenship and Immigration Services (USCIS): As of March 6, you may request premium processing
You have not submitted your Form I-765 yet: Starting on Monday, April 3, you can submit a premium processing request together with your Form I-765 requesting OPT

How To Request Premium Processing

To request premium processing, you must submit the edition of Form I-907, Request for Premium Processing Service dated November 3, 2022. USCIS no longer accepts previous editions of Form I-907.

You may submit the form online through your USCIS online account or by paper. If you want to submit the Form I-907 online but already filed a paper Form I-765, follow the account access notice instructions that USCIS sent you to link your paper Form I-765 to your online account.

Please note you must pay the Form I-907 fee separately from the Form I-765 filing fees. If you submit a single, combined fee payment for multiple forms, USCIS will reject your entire filing.

Why This Matters

While we are pleased to see USCIS offer premium processing to students applying for OPT, we continue to hear stakeholder feedback in support of expanding premium processing to additional applicants and regularly raise this feedback with USCIS.

USCIS announced it intends to further expand premium processing in 2023:

May: For certain student and exchange visitors with a pending Form I-539, Application to Extend/Change Nonimmigrant Status
June: For certain student and exchange visitors filing initial Form I-539 applications

Willow drilling project approved. Where do we go from here?

Dear Peter,

Despite the steadfast efforts of Indigenous leaders and climate justice advocates, the Biden administration just approved ConocoPhillips’ Willow project in the Western Arctic, setting the stage for drilling and development that will add more than 280 million metric tons of climate pollution to the atmosphere over the next 30 years and put Alaska Native communities at risk.

Where do we go from here? For starters, we will be taking the administration to court. After a year of record progress on climate, this decision goes against the administration’s own goals on climate and prioritizing environmental justice. It puts fossil-fuel profits and politics over people, and we’ll do everything possible to fight it.

But even from this terrible news, there’s a heartening lesson. The fight is FAR from over. In the last few months, young activists seized the moment to drive more than 5 million comments to the White House, asking the Biden administration to stop the Willow project.

Make no mistake: The Willow approval is a terrible blow to nearby Indigenous communities like Nuiqsut, and to those millions of impassioned young people, including many of you. But the #StopWillow movement, which garnered major coverage by everyone from CNN to The Washington Post, showed just how loud our collective voices can be.

We can and will be using that power to keep fighting back against Willow. We’ll use it to push this administration to start making every leasing and permitting decision through the lens of a comprehensive plan to make public lands part of the climate solution. We’ll use it to ensure our representatives in government—including everyone from Members of Congress to state legislators to county commissioners—make decisions based on the health of our climate, our future and our collective well-being. We’ll continue to call them. Email them. Visit their offices.We’re not going away.

We will be sure to keep you updated on opposition to the Willow project in the coming weeks and months. In the meantime, thank you for your energy and support.
