USCIS Announces DHS Extension of Flexibility in Requirements Related to Form I-9 Compliance

Dear Stakeholder,

The Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) have announced an extension of the Form I-9 requirement flexibilities that were set to expire on August 31, 2021. Because of ongoing precautions related to COVID-19, this temporary guidance has been extended until December 31, 2021.

The extension applies to the initial March 20, 2020 announcement that employers only need to inspect employees’ Form I-9 identity and employment eligibility documentation in person for employees who physically report to work at a company location. Those hired exclusively in a remote setting are temporarily exempt from the in-person physical inspection requirements.
